RESOLUCIÓN de 22 de enero de 2009, de la Dirección General de Administración Educativa, por la que se modifica la autorización por cambio de titularidad y de denominación específica del centro privado autorizado superior de diseño «Centro de diseño San Valero» de Zaragoza.

Examinado el expediente promovido a instancia de la titularidad del centro privado autorizado superior de diseño «Centro de diseño San Valero» de Zaragoza (código de centro 50017059), situado en avenida Alcalde Sáinz de Varanda nº 1-3 de Zaragoza y del representante de la Fundación «Acción creativa», solicitando el cambio de titularidad a favor de esta última, así como el cambio de denominación específica del centro, pasando a denominarse «Centro de diseño Hacer Creativo».

Visto el contrato privado con firma protocolizada ante notario de cesión de titularidad y demás documentación obrante en el expediente.

De conformidad con lo dispuesto en el Real Decreto 321/1994, de 25 de febrero, sobre autorización a centros docentes privados para impartir enseñanzas artísticas, esta Dirección General de Administración Educativa, en virtud de la Orden de 19 de agosto de 2003, del Departamento de Educación, Cultura y Deporte, de delegación de competencias en materia de autorización de centros, resuelve:

Primero.-Modificar la autorización del centro privado autorizado superior de diseño «Centro de diseño San Valero» de Zaragoza (código de centro 50017059) con domicilio en Avenida Alcalde Sáinz de Varanda nº 1-3 de Zaragoza, por cambio de titularidad del centro que lo será a favor de «Fundación Acción Creativa» y por cambio de denominación específica del centro que pasa a ser «Centro de diseño Hacer Creativo», todo ello con efectos del inicio del curso 2008-2009.

Segundo.-La nueva titularidad «Fundación Acción Creativa» queda subrogada en la totalidad de las obligaciones y cargas que tenga contraídas, en su caso, la entidad «Fundación San Valero«, anterior titular del centro docente, especialmente las relacionadas con las ayudas y préstamos que pudiera tener concedidos por la Administración educativa, así como aquellas que le correspondan en el orden docente y las que se deriven de la vigente legislación laboral.

Tercero.-Esta modificación de la autorización no afecta al régimen de funcionamiento del centro.

Cuarto.-Contra la presente Resolución, que pone fin a la vía administrativa, podrá interponerse recurso potestativo de reposición ante la Consejera de Educación, Cultura y Deporte, en el plazo de un mes, a contar desde el día siguiente a la publicación del presente acto, de conformidad con lo establecido en los artículos 116 y 117 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, en la redacción dada por la Ley 4/1999, de 13 de enero, o recurso contencioso-administrativo ante el Tribunal Superior de Justicia de Aragón, en el plazo de dos meses, contados desde el siguiente a su publicación, de acuerdo con lo dispuesto en los artículos 25 y 46.1 de la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción contencioso-administrativa.
